TERMS AND CONDITIONS OF SALE OF When in Home Ltd T/A Alphapet®

1          DEFINITIONS

1.1         “Buyer” means the individual or organisation who buys or agrees to buy the Goods from the Seller;

1.2         “Consumer” shall have the meaning as described in Section 12 of the Unfair Contract Terms Act 1977;

1.3         “Contract” means the contract between the Seller and the Buyer for the sale and purchase of Goods incorporating these Terms and Conditions;

1.4         “Goods” means the articles that the Buyer agrees to buy from the Seller;

1.5         “Seller” means When in Home Ltd who trade as Alphapet® from Unit 4 Roseacre, Mealsgate, Wigton, CA7 1AW

1.6         “Terms and Conditions” means the Terms and Conditions of sale set out in this agreement and any special terms and conditions agreed in writing by the Seller;

1.7         “Website” means www.alphapetuk.co.uk

2       CONDITIONS

2.1       Nothing in these Terms and Conditions shall affect the Buyer’s statutory rights as a Consumer.

2.2       These Terms and Conditions shall apply to all contracts for the sale of Goods by the Seller to the Buyer and shall prevail over any other documentation or communication from the Buyer.

2.3       Acceptance of delivery of the Goods shall be deemed conclusive evidence of the Buyer’s acceptance of these Terms and Conditions.

2.4       Any variation to these Terms and Conditions (including any special terms and conditions agreed between the parties) shall be inapplicable unless agreed in writing by the Seller.

2.5       Any complaints should be addressed to the Seller’s address stated in clause 1.5.

3       ORDERING

3.1       All orders for Goods shall be deemed to be an offer by the Buyer to purchase Goods pursuant to these Terms and Conditions and are subject to acceptance by the Seller. The Seller may choose not to accept an order for any reason.

3.2       Where the Goods ordered by the Buyer are not available from stock the Buyer shall be notified and given the option to either: select a different option, wait until the Goods are available from stock or cancel the order and receive a full refund within 14 days.

4       PRICE AND PAYMENT

4.1      The price of the Goods shall be that stipulated on the Website. The price is inclusive of VAT.

4.2       The total purchase price, including VAT, delivery and other charges, if any, will be displayed in the Buyer’s shopping cart prior to confirming the order.

4.3       After the order is received the Seller shall confirm by email the details, description and price for the Goods together with information on the right to cancel if the Buyer is a Consumer.

4.4       Payment of the price plus VAT and delivery charges must be made in full before dispatch of the Goods.

5       RIGHTS OF SELLER

5.1       The Seller reserves the right to periodically update prices on the Website, which cannot be guaranteed for any period of time. The Seller shall make every effort to ensure prices are correct at the point at which the Buyer places an order.

5.2       The Seller reserves the right to withdraw any Goods from the Website at any time.

5.3       The Seller shall not be liable to anyone for withdrawing any Goods from the Website or for refusing to process an order.

6       DELIVERY

6.1      All products on sale at Alphapetuk.co.uk include a FREE delivery service. This applies to orders placed on the website for mainland UK address only. Please contact us if the shipping address is not mainland UK for a delivery quotation by emailing sales@alphapetuk.co.uk

6.2         Orders placed on www.alphapetuk.co.uk are generally processed within 24 hours of payment. We dispatch products every weekday, Monday to Friday. We aim to deliver all orders within 48 hours of dispatch, however depending on courier delays, this is not always possible. We do not dispatch orders on Saturdays, Sundays, or UK Bank Holidays.

6.3         Depending on the size and weight of the parcel, the courier may vary. This is important to note when orders have more than one type of item. All orders will require a signature on delivery.

6.4         In the unlikely event that your order has not arrived within the estimated delivery time, please contact us on sales@alphapetuk.co.uk    quoting your order reference number.

6.5         Working days are classed as Monday – Friday (excluding bank holidays and public holidays) – therefore any orders placed on Friday afternoon may be processed over the weekend but will not be dispatched until Monday.

6.6         All delivery timescales are approximate and subject to availability. During busy period such as Christmas couriers may experience delays meaning deliveries may take longer than expected to arrive. Although we will always help in any way we can, we cannot be held responsible for any delays caused by the couriers. We offer no guaranteed delivery times; delivery times are set by the couriers.

6.7         Please ensure that you supply the correct delivery address details at checkout, we cannot be held liable if you fail to provide the correct address. We will not replace or re-send any order at our expense if the details that have been supplied by you are incorrect.

6.8         Please inspect the packaging on arrival before signing to make sure that no damage has been caused while in the courier’s possession. You are signing for the item in perfect condition. If any damage has been sustained to the item on arrival, then please refuse to accept the delivery so that the item can be returned back to us. We cannot be held responsible for any damage discovered after the item has been signed for.

7       WEBSITE CONTENT ACCURACY/DESCRIPTION OF GOODS

7.1         The Seller takes care in the preparation of the content of this Website. The Seller endeavours to ensure that all prices quoted are correct at time of publishing and that all products have been accurately described.

7.2         Prices are quoted in pounds sterling and include VAT. Packaging may vary from that shown.

8.3         The weights and dimensions may vary slightly.

7.4         The Seller strives to ensure that the colours featured on the Website are as accurate as possible however colours can and do look slightly different depending on the monitor/smartphone/tablet being used to view. The Seller cannot be held liable for any slight differences in shade to delivered products.

8          LIMITATIONS OF LIABILITY

8.1      Except as may be implied by law where the Buyer is dealing as a Consumer, in the event of any breach of these Terms and Conditions by the Seller the remedies of the Buyer shall be limited to damages which shall in no circumstances exceed the price of the Goods and the Seller shall under no circumstances be liable for any indirect, incidental, or consequential loss or damage whatever.

8.2         Nothing in these Terms and Conditions shall exclude or limit the liability of the Seller for death or personal injury resulting from the negligence of the Seller or that of the Seller’s agents or employees.

8.3       WAIVER

8.4         No waiver by the Seller (whether express or implied) in enforcing any of its rights under this contract shall prejudice its rights to do so in the future.

8.5       FORCE MAJEURE

8.6         The Seller shall not be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to, acts of God, strikes, lock outs, accidents, war, fire, failure of any communications, telecommunications or computer system, breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply, and the Seller shall be entitled to a reasonable extension of its obligations.

8.7       SEVERANCE

8.8         If any term or provision of these Terms and Conditions is held invalid, illegal or unenforceable for any reason by any court of competent jurisdiction such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if these Terms and Conditions had been agreed with the invalid illegal or unenforceable provision eliminated.

9          CHANGES TO TERMS AND CONDITIONS

9.1         The Seller shall be entitled to alter these Terms and Conditions at any time but this right shall not affect the existing Terms and Conditions accepted by the Buyer upon making a purchase.

10        GOVERNING LAW AND JURISDICTION

10.1       These Terms and Conditions shall be governed by and construed in accordance with the law of England and the parties hereby submit to the exclusive jurisdiction of the English courts.

11        RETURNS, REFUND AND CANCELLATION POLICY

 11.1       At Alphapet we have a 30-day return policy, which means you have 30 days after receiving your item to request a return.

11.2       To be eligible for a return, your item must be in the same condition that you received it, unworn or unused, with tags, and in its original packaging. You’ll also need the receipt or proof of purchase.

11.4       If your return is accepted, we’ll send you a return shipping label, as well as instructions on how and where to send your package. Items sent back to us without first requesting a return will not be accepted. Please note that if your country of residence is not United Kingdom, shipping your goods may take longer than expected.

11.5       For all customers the return costs and arrangements for returns are to be arranged by the consumer.

11.6       Your statutory rights are not affected.

11.8       The customer is responsible for ensuring that all goods are returned in their original condition and packaging, and goods must be unused.

11.9       Goods that have been used cannot be returned without a valid reason (for example a manufacturing fault). We reserve the right to refuse any refund if the terms & conditions are not met.

11.10     Once the goods are received, Alphapet® will inspect the goods and process quality control checks to confirm that the goods have not been used and that all items have been returned. We will process a refund for the price which was paid for the goods excluding any delivery or collection costs incurred by the company. We will charge you a 3% handling charge for the original cost of the goods within 30 days of the goods arriving back to us.

11.11     If at any point the customer decides to return a bespoke or custom item or order, we reserve the right to refuse a request for any return or refunds once the designs have been approved and “approved in writing” by the customer.

11.12 FAULTY OR DEFECTED ITEMS

11.13     In the case of the goods being faulty or defective, you must notify Alphapet® within 24 hours of receiving the goods. We will ask you to provide photographic evidence of the fault prior to us arranging to have the item collected and returned to us for inspection. This will enable us to make a decision to either replace or repair the item. We will make a decision to repair or replace the faulty item within 7 days of receiving the goods.

 12        PAYMENT TERMS

12.1       We require full payment for all products sold and accessories prior to dispatch.

12.2       We accept credit cards, PayPal, and bank transfer. All credit/debit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to or does not, for any reason, authorise payment to us, we will not be liable for any delay or non-delivery.

13        WARRANTIES

13.1       Alphapet products are covered by a manufacturer’s warranty against manufacturing defects.

13.2       Alphapet®’s warranty does not cover damage caused to its products by adverse weather, wind, rain, snow or other forces of nature, accidents, improper assembly or dis-assembly or adjustment during set-up or take down, or any abuse, misuse, or neglect by the user.

13.3       Damage caused by incorrect use or incorrect anchoring of products when required in severe weather or through improper use is NOT covered by our warranty.
